Privacy Policy

How we collect, use, store and disclose the personal and credit information you give us, and what you can do about it.

This policy applies to Mortgage Broker Coffs Harbour (ABN 35 361 529 668). We are bound by the Privacy Act 1988 (Cth), the Australian Privacy Principles, and, because we handle credit information, Part IIIA of that Act and the Privacy (Credit Reporting) Code.

What We Collect

We collect what a lender needs to assess you, and nothing we do not need for that purpose.

  • Identity information: your name, date of birth, residential address, contact details and identification documents
  • Financial information: your income, employment, assets, liabilities, living expenses, bank and loan statements, and tax returns or business financials if you work for yourself
  • Credit information: your credit report, credit history, repayment history information, and details of applications you have made
  • Property information: details of property you own or intend to buy, including contracts of sale and valuations
  • Enquiry information: whatever you type into our enquiry form or tell us on the phone

Where the loan involves anyone else, such as a co-borrower, a guarantor or a dependent, we may collect their information too. If you give us somebody else's details, please make sure they know and agree.

How We Collect It

Mostly from you, directly: the enquiry form on this site, phone calls, email, and the documents you send us. We also collect from third parties where you have authorised it: credit reporting bodies, lenders, your accountant, your employer, valuers, conveyancers and government agencies administering the schemes you apply under.

Why We Collect It

  • To assess what you can borrow and which lenders suit your situation
  • To prepare, lodge and manage a credit application on your behalf
  • To meet our obligations under the National Consumer Credit Protection Act 2009, including the Best Interests Duty and responsible lending inquiries
  • To verify your identity under anti-money-laundering law
  • To respond to your enquiry and stay in touch about your loan

If you do not give us the information we ask for, we may not be able to assess your position or lodge an application for you.

Who We Disclose It To

We disclose your information only where it is necessary for the purpose you gave it to us.

  • Lenders and their mortgage insurers, when we submit or discuss an application
  • Credit reporting bodies, where you have consented to a credit check
  • Our aggregator or licensee, whose systems we use to lodge and record applications
  • Valuers, conveyancers, solicitors, accountants and brokers of related products, where you have asked us to work with them
  • Government agencies and regulators, where the law requires it
  • Service providers who host our systems and manage our records under confidentiality obligations

We do not sell your information, and we do not disclose it for another organisation's marketing.

Overseas disclosure

Some of the software we and our licensee use stores data on servers outside Australia, including in the United States. Where that happens we take reasonable steps to ensure the recipient handles your information consistently with the Australian Privacy Principles.

Credit Information And Credit Reporting

Credit information gets extra protection under Part IIIA of the Privacy Act. We obtain a credit report only with your consent. If a credit reporting body holds your information, you can ask it for a copy, ask it to correct a mistake, and, if you have been the victim of fraud, ask it to place a ban period on access to your file.

How We Hold And Protect It

Your information is held in electronic systems that are access-controlled and password protected, and in paper files where we still hold any. We take reasonable steps to protect it from misuse, loss, unauthorised access, modification and disclosure. No system is perfect, and we cannot guarantee the security of information sent to us over the internet.

We keep records for as long as the law requires, generally seven years after our engagement ends, then destroy or de-identify them.

Marketing And How To Opt Out

We may contact you about your loan and about products that may suit you. You can tell us to stop at any time by replying to any message, calling us on (02) 5616 8708, or using the unsubscribe link in an email. We will act on it, and it will not affect any application already underway.

This Website

Our enquiry form sends the details you type to us. We do not run advertising trackers on this site. Your browser may record standard server log information such as IP address, browser type and pages requested, which we use only to keep the site working.

Accessing Or Correcting Your Information

You can ask us for a copy of the personal information we hold about you, and ask us to correct anything that is wrong. Call (02) 5616 8708 or use the form on our contact page. We will respond within a reasonable period, usually 30 days. If we refuse access or a correction, we will tell you why in writing.

Complaints

If you think we have mishandled your information, tell us first. Call (02) 5616 8708 or write to us through the contact page. We will acknowledge your complaint and respond in writing.

If you are not satisfied with our response, you can take the complaint to the Australian Financial Complaints Authority, our external dispute resolution scheme, or to the Office of the Australian Information Commissioner at oaic.gov.au. Both are free to you.
